1.1 We take your privacy very seriously and are committed to protecting the privacy of all visitors and subscribers to our website flopster.com (the “Website”) or our mobile application (the “App”). The App and the Website are collectively referred to as the “Platform”.

1.2 The Platform has been established by us as a Sole Establishment Company in the United Arab Emirates (the “UAE”) (the “Services”). The Platform is operated by Flopster Portal, a sole establishment registered in the Emirate of Dubai, UAE with license number 839373 and registered office, Dubai, United Arab Emirates (“Flopster”).

1.3  We seek to make the Platform as accessible as possible. If you have any difficulties using the Platform, or if you have any questions or enquiries, please contact us by email at hello@flopster.com.

1.4  Please read this privacy policy carefully as it contains important information on who we are and how we collect, store, use and share your information. By accessing the Platform or using our Services or otherwise indicating your consent, you agree to, and where required, consent to the collection, use and transfer of your information as set out in this policy.

1.5 This privacy policy: (i) applies only to the Platform and not to Website or applications of any other companies or organisations; and (ii) specifically addresses our obligations pursuant to the law of the UAE.

2. INFORMATION WE COLLECT ABOUT YOU

2.1 When you visit the Website or the App or create a login in and password to access the Services, you may be asked to provide information about yourself. This may include: (i) your name and contact details, including email address and telephone number; (ii) information to enable us to check and verify your identity; (iii) location data; (iv) your billing information, transaction and payment information and history; (v) information to enable to check and verify any vehicle which you wish to sell or purchase on the Platform; (vi) information to enable us to undertake credit or other financial checks on you and your vehicles; and (vii) such other information as we may from time to time require to provide the Services and comply with applicable law. We may also collect information about your usage of the Platform and the Services and information from messages and communications you send to us.

2.2  This information is required to provide the Services to you. If you do not provide such information, it may delay or prevent us from providing the Services.

2.3 This privacy policy will also apply when accessing the Platform and/or the Services from mobile technology (such as mobile phones, tablets or other devise). Unless you have chosen to remain anonymous through your device and/or platform settings, this information may be collected and used by us automatically if you use the Service and access the Platform from mobile technology.

3. USING YOUR INFORMATION

3.1 Your information will allow us to provide you with access to the particular parts of the Platform relevant to you and allow us to supply the Services you require. We will use and review the information we collect to administer, support, improve and develop our business and the Services from time to time, and as is required by us to comply with applicable law and regulations.

3.2  Your information may be used be us to contact you for your opinions on the Platform, the Services and our business, and to notify you of changes or developments to the Platform, the Services and our business.

3.3 Where you have submitted any comments or feedback regarding the Platform, the Services and/or our business, you consent for us to use such comments and feedback on the Platform and in marketing and advertising materials from time to time. For these purposes we will only identify you by your username.

4. WHO WE SHARE YOUR INFORMATION WITH

4.1 The information you provide to us will be transferred to and stored on our or our affiliates’ servers or the servers of a third party service provider. You acknowledge and consent to the transfer, storage and processing of such information. We will take all steps reasonably necessary to ensure your information is treated securely and in accordance with this policy.

4.2  We routinely share information with: (i) our Affiliates; (ii) third parties we use to help deliver our products and services to you (for example, payment service providers); (iii) other third parties we use to help us run our business (for example, marketing agencies or Website hosts); and (iv) third parties approved by you (for example, social media sites you choose to link your account to or third party payment providers). For the purposes of this policy: (i) “Affiliate” means, in relation to any company, any subsidiary or holding company of such company or any other subsidiary of such holding company; and (ii) “Group” means, in relation to any company, such company and its Affiliates from time to time.

4.3 We only allow our service providers to handle your information if we are satisfied they take appropriate measures to protect your information. We also impose contractual obligations on service providers to ensure they can only use your information to provide services to us and to you. We may also share information with external auditors.

5.4 Notwithstanding the steps which we take, the internet is not an entirely secure medium and privacy can never be guaranteed. We have no control over the practices of third parties. We cannot guarantee the security of your data transmitted to us and/or the Platform and any such transmission is at your own risk.

6.1 We may use your information to send you updates (by email, text message, telephone or post or through the App) about our products and services, including exclusive offers, promotions and new services.

6.2  We have a legitimate interest in processing your information for promotional purposes. This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly. If you have consented, we may allow selected third parties, including marketing and advertising companies, our affiliates and associates, to contact you about products and services we think may interest you.

6.3 We will always treat your information with upmost respect and will never sell it with other organisations outside our Group for marketing purposes.

6.4 You have the right to opt out of receiving promotional communications at any time by:

6.4.1 contacting us; or
6.4.2 using the ‘unsubscribe’ link in emails;
6.5 We may ask you to confirm or update your marketing preferences if you ask us to provide further services in the future, or if there are changes in the law, regulation or the structure of our business.

This privacy policy is dated 10 June 2019. We reserve the right to vary this from time to time. Our updated policy will be displayed on the Platform, and by continuing to use and access the Platform, following such changes, you agree to be bound by any variation made by us. It is your responsibility to check this policy from time to time to verify such variations.
